News video: Trial For Baby Murdered In 1972 ReopenedGary Warwick will be tried for murder 44 years after a child's death. The Illinois man claimed he found his girlfriend's 1-year-old child unconscious on a toy motorcycle. The child, Joey Abernathy, was hospitalized just weeks earlier due to bruises on his face and dog bites. The hospital pronounced him dead due to a laceration in his liver caused by blunt force trauma to the stomach. Although Warwick was charged with murder, the case was dismissed in 1974.
