Elizabeth Holmes granted trial delay due to pregnancy

Theranos founder Elizabeth Holmes' criminal fraud trial has been delayed yet again.

Holmes, 37, is pregnant and due to deliver in July, and on Wednesday her defense attorneys were granted a seven-week postponement to her trial.

Holmes attended a Zoom meeting Wednesday with her lawyers, Judge Edward Davila and Assistant U.S. Attorney Robert Leach. CNBC reported that Leach ruled in the defenses favor, moving the trial from July 13 to Aug. 31.

“It’s frustrating and disappointing to learn about this now,” said Leach, who noted that prosecutors were informed about Holmes’ pregnancy on March 2, according to CNBC.

This news comes after the trial has been delayed three other times due to the coronavirus pandemic, according to the San Jose Mercury News.

An earlier court filing in September revealed Holmes’ counsel may present the issue of mental health as part of her defense strategy.

Holmes and former Theranos president Ramesh “Sunny” Balwani were originally indicted in June 2018 on several counts of conspiracy and wire fraud for allegedly engaging in a multimillion-dollar scheme to defraud investors with blood testing lab services, according to the district court.
