The other big story of the day is out of montgomery county.

After nearly 25 years in prison, curtis flowers was granted bail in montgomery county circuit court..

Judge joseph loper set his bond at $250,000..

Flowers was being held in winston county..

Quentin smith was there when curtis flowers walked out.

He joins us live from louisville with the latest..

Excited and speechless, that's how curtis flowers says he's feeling after being released on bond today.

On your screen is flowers walking out locked arm in arm with family members and attorneys.

The winona man was released from the winston county correctional facility around 4 o'clock this afternoon..

For the first time in more than 20 years curtis flowers will have a chance to be with his family members during the christmas holiday.

He just wishes his mom, who passed away while he was behind bars, was here to witness it.

She would probably be doing flips right now.

She looked forward to this.

She always knew it would come, she said she didn't know if she would be here or not, yeah.

It's been rough, it's been rough.

I've been taking it one day as a and a time, keeping god first., i think that's how i got through it.

I just want to thank all of my supporters and everything."

Once he was released today, family members said they're taking flowers home to fry him some fish and give them a good home cooked meal.

Flowers attorneys say they will pursue having all charges dropped against the winona man in 2020..

Reporting live in louisville quentin smith wcbi news..

Take vo in monitor when winona police officers found the bodies of bertha tardy, derrick "bobo" stewart, robert golden, and carmen rigby in a downtown furniture store, the investigation began.

Winona was a small town.

And it didn't take long for suspicion to land on former tardy employee curtis flowers.

For investigators and prosecutors, it has always been flowers.

But over the years, there have been 6 trials, dozens of jurors, and witnesses who changed their testimony.

There have been mistrials and overturned convictions as well..

The latest coming from the us supreme court this summer..

Today when he went back to court, our cash matlock was there.

He joins us now in the studio.

The courtroom was full this morning.

On one side of the aisle - family and friends of curtis flowers.

They sat right behind him.

On the other side - family of the victims. each side waiting to hear what this judge would say.

"it is the find of this court that mr. flowers is entitled to bail" "this court hereby sets mr. flowers bond in the sum of two hundred and fifty thousand dollars" it took less than thirty minutes for judge joseph loper to give curtis flowers a chance at a life on the outside.

"i'm very pleased with the judge's decision on bail.

For the first time in twenty-three years, curtis flowers will be out of prison.

He's very much looking forward to spending time with his family."

And they were there, his aunts, his dad, his cousins... but one person was missing who faithfully visited him once a week, died just months short of seeing him home, but his cousin says... she knows.

"lady, your baby is home.

That's what i can say.

This is just a tribute to his mother because she's not here to see it, but she always had the faith to know, he was coming home."

His attorney says he should have never been in jail.

"the state of mississippi should have never brought the case in the first place.

Since then, it has just been a litany of misconduct that's lead us to this situation twenty-three years later."

There have been plenty of allegations of misconduct, most of them pointed at district attorney doug evans.

Evans has lead the prosecutor's team on all six trials, but he was not in court today.

"it's doug evans choice not to come to this hearing.

The fact that he didn't come to try to defend what has happened, shows that it's not defense- able."

And in the end, the judge agreed with flowers and his defense attorneys.

"considering all these factors the court is in the opinion that at least reasonable doubt as of mr. flowers guilt can be entertained."

And those words were a long time coming for the people sitting behind him.

"he got his family back."

Take vo in monitor but there is still no closure for the families of the victims. we spoke with each of them.

They all declined to comment.

3 shot cash, the judge had some harsh words for the state of mississippi, is that correct?

Yes judge loper stated that the state of mississippi has taken absolutely no action of any kind in furtherance of the prosecution, even after being ordered to do so.

This includes a failure to write a written response for a motion for bail.

Failure to write a written response for the motion to disqualify district attorney doug evans.

And failure to write a written response to the pending motion to dismiss the indictment.

The judge then issued the state this warning.

"so, i will just have this caution for the state of mississippi.

If it continues ins dilatory conduct, and if it continues to ignore orders issued by the court, the state of mississippi will reap the whirlwind."

It's my understanding that the families of the victims were also in attendance.

What was their reaction to the judge's bond approval?

Aundrea, we spoke with several of the family members that were present today.

None of them wanted to comment or release any sort of statement.

Curtis flowers has been tried 6 times for the same crime - the deaths of those four employees at tardy furniture.

And, he's been found guilty in at least 4 of those trials.

The first was in 1997, just a year after the murders.

But the mississippi supreme court overturned that conviction.

The justices said the state of mississippi, specifically the prosecutor, made mistakes at trial.

The second trial was held on the coast in harrison county in 1999.

Again flowers was found guilty.

The verdict was thrown out again by the state supreme court because of mistakes by the district attorney's office.

The trial moved back to montgomery county in 2004.

The state supreme court pointed at district attorney evans, saying he discriminated against potential jurors who were african american.

That case was overturned.

Trials 4 and 5 ended in mistrials.

Curtis flowers was found guilty at his 6th trial in 2010.

This time, challenges to the verdict made it all the way to the us supreme court, where this summer the justices ruled in flowers' favor, tossing the verdict - based again on discrimination by the prosecutor.

It is now up to that same district attorney to request a date for a 7th trial.
