A federal judge has ruled that Governor Beshear's order closing private religious schools infringes their First Amendment rights.

The judge ruled today that the governor's order cannot apply to private, religious- based schools across the state because it infringes on their constitutional rights.

The order can, however, remain in place for public schools.

Danville christian academy, in boyle county, and attorney general daniel cameron filed the lawsuit against beshear last week.... arguing his executive order violates the first amendment as well as the state's religious freedom restoration act.

Last week beshear issued the school- related order, along with a number of new restrictions.

His team has already appealed the dicision, to the sixth circuit and will request an emergency stay of the judge's order, and, if necessary, will also appeal to the u.s. supreme court.
