According to the complaint allegations, defendants Brochstein and NCV engaged in a long-term, illegal scheme in California involving:

5. Civil Conspiracy Under California Law to Commit Racketeering Subject to Racketeer Influenced and Corrupt Organizations (RICO) Act Under U.S.C. § 1961
6. Civil Conspiracy to Defraud the United States Under California Law
7. Aiding and Abetting Securities Fraud
8. Aiding and Abetting Racketeering
9. Aiding and Abetting Plot to Defraud the United States
10. Intentional Infliction of Emotional Distress

The complaint cites Brochstein and NCV's solicitation for advertising services of Plaintiff and CTI using CFA credentials in California which was declined twice, leading to negative coverage of Plaintiff and issuer CTI Defendants Brochstein and NCV allegedly decline to update its coverage following the May 2, 2017 article citing Dr. Mohammed Zakhireh in a broader conspiracy and aiding and abetting a scheme involving defrauding the SEC, and a failure to cover 23 (twenty-three) different enumerated material events that demonstrably show innocence of Plaintiff and allegedly a lack of neutrality and objectivity of Brochstein and his publisher NCV.

In addition to damages, the complaint seeks to permanently enjoin Alan Brochstein, CFA and New Cannabis Ventures from publishing articles that lack adequate disclosure of their solicitations for payment from companies, which the complaint cites is the "more strict, law, rule, or regulation" to which a CFA "must" comply to avoid misleading investors who may erroneously believe New Cannabis Ventures or Alan Brochstein, CFA's articles are neutral.

The complaint also includes a detailed accusation drafted by Beck that was submitted to the California Supreme Court against three attorneys who have been involved in a list of cases amidst directly adverse parties in the same court with conflicting allegations, at least one of whom was communicating directly with Brochstein. Most of these cases resulted in disqualification of the Attorneys for violations of the Rules of Professional Conduct. In one case, several Alleged Co-Conspirators are alleged to have been criminally extorted by the Attorneys in exchange for manufactured evidence. Plaintiff alleges Brochstien and NCV were involved in the scheme as evidenced by their ongoing refusal to update their coverage despite their alleged requirement to do so when they used their CFA credentials to solicit Plaintiff for business services (advertising).

"There are approximately 70,700 followers of Mr. Brochstein on Seeking Alpha, 33,400 followers on Twitter, 14,680 followers on LinkedIn, 11,990 on Facebook, and 2,124 have rated or reviewed his 420 Investor email service. It is unknown how many other people or private and public issuers might be affected through "NY Times, Wall Street Journal, Fox Business, or Bloomberg TV" for which Mr. Brochstein purports to be a frequent source, but it seems these outlets reach more than 250,000,000 people. I am just a regular person trying to influence positive change in our world and won't stand for injustice by people who allegedly hide behind credentials as if it were a license to do or say whatever they want - especially when they are required to be objective."

"I believe tens of thousands of investors' rights have been violated, and the City of Coachella was robbed of critical economic development and hundreds of jobs because I failed to pay Mr. Brochstein for advertising services twice resulting in his campaigns of coverage under the false guise of neutrality using a CFA designation. Investors should be extremely diligent when considering purportedly neutral content they consume and the potentially undisclosed motivations of bloggers or writers. Readers - especially investors influenced by articles or "alerts" published by New Cannabis Ventures, 420 Investor, or Alan Brochstein, CFA on information and belief - are also urged to understand the heightened standards and rules to which a CFA must comply according to their accreditation and purported neutrality, which can be found through CFA Institute. A CFA is required to know "all laws" in each jurisdiction in which they operate (California and the United States, in this instance) - and provide disclosures of "all" matters that might affect their objectivity in coverage.

On information and belief as so alleged by Beck, issuers should also be cautious when solicited for advertising and the potential implications of declining the services of Alan Brochstein, CFA or sites he controls. The NewCannabisVentures.com website and the paid 420 Investor e-mail service purportedly include in some capacity the highly regarded website Benzinga.com - although it is not known if Benzinga is aware of the allegations or underlying facts involving Brochstein as a CFA outlined in the complaint, or the heightened standards of disclosures the CFA Institute requires when using the CFA designation in commerce.

Beck previously documented his complaint to CFA Institute, although it does not appear they enforced their Code of Ethics or Standards of Professional Conduct, much like the California State Bar failed to act in Beck's complaint regarding the Attorneys referenced in his Complaint. Plaintiff alleges these are civil torts, though, in California Unfair Competition Law, and that the broader implications of Defendant Brochstein and NVC's selective publication alleged demonstrate a pattern of conspiracy and aiding and abetting the Alleged Co-Conspirators from May 2, 2017 to present. Plaintiff alleges they may give rise to criminal prosecution, too.
