Developing--an attorney representing an evansville mother who lost her two children in a deadly car accident--- making an announcement this afternoon.... 44news reporter megan diventi has been following this story all day-- and joins us live in evansville with the latest details.

Brian--jessica-- we are coming up on the 3-year anniversary of that deadly accident.... family and friends meeting earlier today--- at the site of where it all happened..... the accident taking place at the intersection of monroe and linwood avenue..... janae carter and her unborn child survived the 20-17 crash.... her other two children died at the scene---and their father died a month later from his injuries... their car was hit during an unrelated police chase.... carter is suing the city for wrongful death of her children.... "we think the city was negligent in pursuing mr. mcfarland far longer than they should've to the point where it became almost like a diminishing return.

The benefit of apprehending him was outweighed by the cost to the public of such a dangerous situation."

"i just want justice .

If it take another two or three years it is what it is.

It's about justice for the babies at the end of the day because i just don't believe that it should've happened.

I beieve they would still be here if this chase wouldn't have happened."

The family's attorney says they were going to trial in june of this year--- but covid-19 put that on hold..... as you saw in that video--the family placing balloons and ribbons as a memorial where the incident happened..... the family attorney tells me they hope to have a trial underway by this time next year.... reporting live in evansville-- md--44news.
