CORRECTION: CORRECTS NAME IN HEADLINE FROM KEVIN 'SPACE' TO 'KEVIN SPACEY' Prosecutors in Massachusetts have dropped a criminal sexual assault case against former "House of Cards" star Kevin Spacey.
The case alleged the 59 year old actor had groped an 18-year-old man at a bar in Nantucket three years ago after buying him several drinks.
But on Wednesday, prosecutors withdrew the felony assault charge, after Spacey's accuser invoked his 5th Amendment right against self-incrimination.
He did did so after the judge in the case ordered him to provide his cellphone, and was told the phone was missing.
The Oscar-winning actor had pled not guilty, and his lawyers had accused the plaintiff of deleting text messages that would have supported the actor's defense.
The accuser dropped a civil suit against Spacey earlier this month.
