Justice Dipankar Datta questioned if the Preamble could have been amended without changing the date of adoption by the Constituent Assembly. Swamy argued against the amendments made during the Emergency in 1976. Advocate Sriram Parakkat argued that the addition of 'secularism' and 'socialism' in the Preamble did not violate the basic structure of the Constitution.
