A Clinton Street homeowner says a shooting suspect was not in his home Tuesday morning when officers surrounded it.

What exactly happened that day.

19 the thing is it was just a bad seen.fred duncan could only stand by and watch tuesday as a fort wayne police swat team surrounded his home and filled it with tear gas with four of his friends inside.

?there was a point where it became a training exercise.

If i'm saying he's not in the house or who are you looking for and these are the four people in the house and then these four people didn't come out.

The whole thing is fractured.fractured duncan says because the man police were looking for was ?not?

Inside his house that morning.

And for whatever reason his friends still refused to come out.

?the third roommate told them basically to sit tight and they'll go away.

In a normal investigation that's probably true.

They're just showing up and questioning people but when the tank rolls in the back yard and the megaphone starts i don't think that's exactly the case any more.

The man police were looking for that day was actually 30-year-old tracy baker.

An affidavit says baker fired a shotgun at several people that morning as they sat on the front porch of a harrison street home.

A man was shot in the shin.

Duncan considers baker a friend.

He says things took a turn for the worse when one of the witnesses to the shooting told police she saw baker enter duncan's home three blocks away.

1:21 i'm not sure if he was involved in any of that or not.

I did not see any of that.

But she walked the police over here and pointed at my house and that he had gone in.

He had not gone into the house.

Sofia rosales-scatena says they could only go with the information they had at that time.

"hindsight's always 20/20 in these situations.

These incidents rapidly evolving.

Very dangerous.

High potential for danger.

We already had someone shot, shot aat.

We go with information can we're provided with as we get it.

She pointed out that they gave the men inside multiple opportunities to exit the home the men only came out after police shot tear gas through the windows several hours later.

Most people should know if you're not wanted by the police you should just leave the house.

My one 'friend' did not.

I feel he's directly responsible for the tear gas canisters."

Duncan says the police were professional but he wishes they would have let him persuade his friends to come out.

Instead they made him leave.if i could have come back and yelled at these people and made them come back but they didn't let me do that.

Rosales-scatena says that was never an option for duncan's own safety."we do not let people reenter where there's a possible shooter inside.

They could take another hostage at no point do we let someone go inside.

If we let someone go inside and something bad happens we have responsibility for that.

Ironically police would eventually catch baker at duncan's house two days later.

Duncan says tracy asked to use his computer to get money from his family i'm like you can't be here.

It's probably the worst place for me for you to be and for you.

Duncan says tracy kicked in his door after he asked him to leave.

That's when duncan called police.what did he expect me to do?

Chat and cup of coffee?

No.

Tracy is now charged with battery with a deadly weapon criminal recklessness and residential entry into duncan's home.

Duncan who's now left with holes in his windows and fewer friends says police never talked to him about the damage to his home.

They did not call me for any of the warzone that happened.
