Attorney Gary Massey talks about job-related challenges during Covid times including wrongful termination

For joining let's just our attorney friend gary massey from massey at associate spending a few minute with us this morning.

Gary massey good to see you as always, you will be here well i wish you were here in person.

Maybe your next visit will be able to come out here and socially distant.

On the whole, obviously, yet we missing you t really really a few questions we got and then into the mailbag and i want to kinda consolidate some of these and ask you about folks who are being forced to return to work in spite of the coven, 19 virus going around a lot of the ring told you have t come back into the office and do your job is a legal well there are a lot of different things that come into play their chip and so it's hard to give a really short answer to the question i just had to pick one between yes and no.

Yes.

But there are definite restrictions and requirements paid placed on employers and so employers are required to follow the governmental regulations one to call employees back to work and course a lot of employees are social workers, and never, you know, never were allowed to wor from home.

Their job is is not the time job as a person can do from home so they had to work in the workplace around a lot of other fellow employees, and think about nature and so employees are entitled to the protections of social distancin, to the extent of those things are reasonable and so if an employer is not providing those protections and in his required people were invented, it brings in several different aspects of of different walls in specific statutes that might come into play are in a relationship taking that a little bit further.

Can your employer require or tell you to buy personal protection equipment, whether it's a mass loves up a shield or what i without you being reimbursed ... will there's not a specific rule that this is this is one of the interesting things in india they would look to other parts of the labor law passed in certain types of these traditionally have been required to provide their own equipment and employees have not been worked out and so the answer is in a lot of situations, the employer can require the lead to provide their own but typically that's not the case and if an employee fails to do it because the employer provide all the other equipment that might create a wrongful discharge type situation.

If the employer fire the employee for failing to provide their own but it is saf to say that by and large most people's rights are still intac, just like you were.

Prior to this whole thing analyst comes along rush but still the essential rights of the lawyers and the employees are still in place in you.

There is legislation in playing the government, which is called the legislature back into session t try to pass on protections for employers and businesses that might endanger the rights of employee any idea and i know this is kind of hard to say in the review time have any idea how this whole coven pandemic thing, assuming it eventually columns down and goes away as i going to affect the legal landscape for you to see more cases being tried elect chronically or going to see less activity, less physical activity in our courtrooms. you thoughts ... well one of the things that we are definitely going to see is a gigantic backlog of cases and the legal industry legal system has been criticized for a long long time about being slow in cases taking a long time.

Will that problem is going to get a lot worse because so few cases are being tried right now and s many different litigants are using the pandemic is a method to extend the life of the case even long and so the the ability of a person to get a final resolution to their case is going to take even longer.

Even after this is over in right now to my knowledge there are two jury trials in state since the since the middle of march and that's probably less than one percent of what it would've bee hundred circumstances.

All those other cases.

Artist backing up next to be backed up until everything goes back to if we ever do find it back to normal.

One final question, gary.

Are you seeing an uptick in any specific type of case in your office.

Assume associates we are seeing a lot of cases regarding wrongful termination, specifically with americans wit disabilities act people being fired because they're sick family medical leave act people not being given their time off from work rights that are required under federal law, things of that nature in and those employees are feeling really unfairly treated have trouble finding a job is likely to bring a claim under those kinds of law, but it is basically business as normal.
